1. Our Role
Bora Bora Bound is an independent travel advisor. We act as an intermediary between you and the third-party suppliers who actually provide your travel — including airlines, cruise lines, hotels and resorts, tour operators, transfer companies, and other vendors ("Suppliers"). We do not own, operate, or control any Supplier.
Your travel is also subject to each Supplier's own terms and conditions, which you are responsible for reviewing. Where a Supplier's terms conflict with these terms regarding the services that Supplier provides, the Supplier's terms control for those services.
2. Client Responsibilities
- Provide complete and accurate information, including legal names exactly as they appear on the travel documents you will use.
- Review every quote, invoice, and itinerary promptly and notify us of any error before deadlines pass.
- Meet all payment, document, and check-in deadlines set by us and by Suppliers.
- Ensure that all travelers in your party are aware of and accept these terms and the applicable Supplier terms.
- Comply with the rules, conduct policies, and health and safety requirements of each Supplier and destination.
3. Travel Insurance
We strongly recommend that every traveler purchase comprehensive travel insurance covering trip cancellation and interruption, medical care and emergency evacuation, baggage, and related risks. Insurance can protect a significant portion of your trip cost in the event of an unexpected change. If you decline travel insurance, you do so at your own risk and accept full responsibility for any resulting losses.
4. Payments, Fees & Pricing
- Deposits, payment schedules, and final-payment deadlines are set by the Suppliers and will be communicated to you. Missing a deadline may result in cancellation and penalties imposed by the Supplier.
- We may charge professional planning or service fees for our time and expertise. Any such fee will be disclosed to you in advance, and unless stated otherwise it is non-refundable once work has begun.
- Prices and availability are not guaranteed until your booking is confirmed and paid in accordance with Supplier requirements. Quoted pricing may change due to Supplier increases, currency fluctuations, taxes, or fees outside our control.
- Payments to Suppliers are typically made directly to the Supplier or processed on the Supplier's behalf.
5. Cancellations, Changes & Refunds
Cancellations and changes are governed by the policies of the applicable Suppliers and may carry penalties up to the full cost of the trip. To request a cancellation or change, contact us in writing; the effective date is when we are able to process the request with the Supplier, subject to that Supplier's terms.
Refunds, when available, are issued by the Suppliers and passed through to you only after we receive them. Any professional fees charged by Bora Bora Bound are non-refundable unless expressly stated otherwise.
6. Limitation of Liability
Because we act only as an intermediary, Bora Bora Bound is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier, or for any injury, death, loss, delay, damage, or inconvenience arising from such causes. We are likewise not responsible for events beyond our reasonable control, including weather, natural disasters, illness or epidemics, strikes, government action, supplier insolvency, mechanical or itinerary changes, or force majeure. To the fullest extent permitted by law, our total liability for any claim relating to our services will not exceed the professional fees you paid directly to Bora Bora Bound.
7. Documentation & Entry Requirements
You are responsible for obtaining and carrying all documents required for your trip, including valid passports, visas, and any health, vaccination, or entry documents required by your destinations and any countries of transit. Many destinations require a passport valid for at least six months beyond your travel dates. We can share general guidance, but requirements change frequently and final responsibility for meeting them rests with you. We are not liable for any loss resulting from missing or non-compliant documentation.
8. Supplier Modifications
Suppliers may modify schedules, itineraries, equipment, accommodations, ports of call, or other trip elements before or during travel. Such changes are made at the Supplier's discretion and are outside our control. We will assist you in responding to changes where we reasonably can, but we are not responsible for them.
9. Dispute Resolution & Governing Law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The parties will attempt to resolve any dispute in good faith before pursuing formal proceedings. Any dispute that cannot be resolved informally will be handled in accordance with the dispute-resolution process specified in your booking documents or, absent that, in the state or federal courts located in California.
10. Seller of Travel Disclosures
- California: Seller of Travel Registration CST #2063964-50. Registration as a seller of travel in California does not constitute approval by the State of California.
- Florida: Seller of Travel Registration No. ST17873.
- Washington: Seller of Travel/UBI No. 602232785.
11. Consumer Notice
Bora Bora Bound is not a participant in the California Travel Consumer Restitution Corporation (TCRC). California law provides that California residents are not eligible for TCRC restitution for transactions with sellers of travel who are not participants. You may cancel certain transactions and obtain a refund only as provided by applicable law and the cancellation terms disclosed to you at the time of booking.
12. Electronic Acceptance
You agree that submitting a trip request, replying by email, checking an acceptance box, or otherwise indicating agreement electronically has the same legal effect as a handwritten signature, and that records and communications may be maintained and provided electronically.
13. Acknowledgment & Acceptance
By requesting a quote, submitting a trip request, or making a booking with Bora Bora Bound, you acknowledge that you have read, understood, and agree to these Terms & Conditions on behalf of yourself and all travelers in your party. If you do not agree, please do not book.
